Proceedings in Immigration Court are often very complicated. Respondents who are represented by an attorney have a higher likelihood of a successful outcome to obtain relief in the form of a lawful immigration status or to at least avoid deportation. Successful outcomes for certain individuals may be obtained in immigration proceedings in the following ways, among others:
- Asylum
- Withholding of Removal
- Protection pursuant to the Convention Against Torture (CAT)
- Cancellation of Removal
- Suspension of Deportation or Special Rule Cancellation of Removal pursuant to the Violence Against Women Act
- Nicaraguan Adjustment and Central American Relief Act (NACARA)
- Certain individuals from Guatemala, El Salvador, and former Soviet Bloc countries may be eligible.
- Adjustment of Status
- Prosecutorial Discretion
- Defects in the Notice to Appear
- Voluntary Departure
- Waivers (212(c); 212(h); 601a)
